Thank you for choosing Moshie Print! These terms and conditions govern the use of our website, as well as all the services we offer, and constitute a mutual agreement between you (hereinafter "the customer") and Moshie Print (hereinafter "the company").

By contracting our services, you fully accept the terms and conditions described below. Therefore, we recommend that you read them carefully and understand them before proceeding.

Contracting our services

We offer a diverse range of services, primarily focused on the graphic design and printing sector. We are committed to our customers, and their satisfaction is our top priority, ensuring that we will do everything in our power to provide you with the highest quality service and results. Our services can only be contracted through our official contact channels, detailed below:

  1. Website. You can initiate the service contracting process through the contact form available at https://moshieprint.com/. Payment terms

The customer commits to paying the total amount corresponding to the contracted services, with prior consent. The customer agrees to provide their fiscal information to the company if an invoice is required. In the event of not providing fiscal information, the company reserves the right to invoice the payments received as cash sales, in accordance with current legislation. The agreed-upon price is not subject to negotiation, discount, or reduction unless suggested by the company. The various services offered are subject to the following conditions:

  1. Photocopies. For photocopy and reproduction work, the amount to be paid will be settled according to the following guidelines:
    1. In person. Applicable when the customer visits the company's premises. If the customer remains present until the completion of the work, they will pay the amount specified by the company after the work is finished and received. If the customer needs to leave and wishes to collect the order later, they must make an upfront payment before leaving the premises; the percentage of this upfront payment will be determined by the company.
    2. Electronically. Applicable when the customer submits electronic files for photocopying. The total amount of the order will be communicated to the customer. If the amount is less than or equal to €10, it must be paid in full before production begins. If the amount exceeds €10, an upfront payment must be made to confirm the order; the percentage of this upfront payment will be determined by the company.
  2. Graphic design and printing. For digital work, including graphic design, layout, and/or computer simulation, the company will provide the customer with a customized quote. Once approved, the customer must pay 50% of the total amount to confirm the order. The remaining 50% will be paid upon receipt, delivery, and/or installation of the work
  3. Personalization. For work related to personalization, including (but not limited to) keychains, earrings, postcards, stickers, small-format decorations, among others, the company will provide the customer with a customized quote. Once the quote is approved, an upfront payment must be made; the percentage of this upfront payment will be determined by the company.

We inform you that the company will be exempt from all responsibility and/or claims regarding orders that lack an upfront payment or advance payment, as outlined in this section. If payment is not made in accordance with the conditions described in this article, the company will not be obligated to fulfill the delivery or completion of the corresponding work.

Non-payment conditions

In case the customer fails to make full payment for their order, the company reserves the right to utilize all legal means at its disposal to collect the outstanding revenues related to unpaid orders. Additionally, the company reserves the right to report to the authorities, in the case of hostile customers who not only fail to pay in full for the services rendered but also explicitly refuse to do so.

Please be informed that customers who delay payment of the remaining amount of their order beyond a reasonable period may be added to a blacklist. The exact time considered reasonable will be determined by the company based on the specific circumstances of each case.

The company reserves the right to refuse to work with customers on its blacklist due to unpaid amounts or substantial delays in remaining payments.

Refund policy

The company offers both digital and physical/tangible products and services. In the event that the customer is not satisfied with the provided services, they can adhere to the conditions applicable to their case:

  1. Digital services. Applicable to intangible services, such as graphic design, layout, computer simulations, among others. The guidelines described in Article 5: Creative Process will be applied; these guidelines are specifically designed to ensure customer satisfaction. However, if this is not possible, and the customer expresses dissatisfaction with the services provided, they will not be entitled to any kind of refund or reimbursement, as these services result from the time and creative effort of the company.
  2. Tangible services. We offer tangible and physical products/services to our customers. However, these can be of various types, and policies are applicable according to the case:
    1. Small format. Applicable to printed products intended for personal use, short-term use, and/or advertising purposes. This includes, but is not limited to, posters, cards, flyers, restaurant menus, keychains, among others. The guidelines described in Article 6: Production Process will be applied. In the event that the customer is dissatisfied with the received product, a reprint will be offered. If the customer rejects the reprint of the product(s), a refund will only be possible if requested within 14 calendar days after receiving the product, and provided that the quality of the received product is of a defective and/or unacceptable quality.
    2. Large format. Applicable to printed products intended for advertising use, whether short or long term, and generally affixed to a physical space, whether indoor or outdoor (street). This includes, but is not limited to, vinyl, banners, posters, roll-ups, easels, advertising stands, among others. Depending on the case, the guidelines described in Article 6: Production Process or Article 7: Installation Process will be applied. In the event that the customer is dissatisfied with the received or installed product, any demonstrable claim regarding its quality will be considered valid. In such cases, a reprint or reproduction of the product will be offered. If the customer rejects the solution offered by the company, a refund will be possible under the following conditions:
      • The customer must file the claim within 14 calendar days.
      • The company reserves the right to remove, detach, uninstall, and/or confiscate the refunded product(s), with the customer having no right to retain them.

Creative process

The company offers creative services, including graphic design, layout, computer simulations, among others. These services are of a digital nature until they are printed. Once the printing or production process begins, the conditions described in Article 6: Production Process will also apply. The services described in this article are governed by a creative process, as described below:

  1. Initiation. The creative process will begin once the corresponding payment conditions have been met. The customer agrees to provide a clear and detailed description of the requirements and specifications for the design they want the company to develop satisfactorily. These details are essential to ensure that the final result meets the customer's expectations.
  2. Development. The company will do everything in its power to meet the creative requirements and specifications provided by the customer. Our top priority will always be to ensure customer satisfaction with the work done. Once prepared, a preview that closely approximates the final appearance of the design will be shown to the customer. The customer may request changes and revisions to ensure that the design meets their needs and expectations. Once the design is finalized, a final preview will be provided to the customer for review. In the case of restaurant menus and menus, the customer assumes:
    • They will provide the company with a detailed list of the dishes they want to display on it.
    • They will provide the company with the list of allergens corresponding to the dishes shown in their menu.
    • The company is exempt from all liability regarding the accuracy of the allergens shown in their menu, as this is the customer's direct responsibility.
  3. Completion. Once the customer receives the final preview, if they are satisfied with the design, the customer will communicate their explicit approval to the company. Consequently, the customer assumes:
    • They will have reviewed and carefully read the final preview before conveying their approval to the company.
    • The company will verify the textual integrity of the design before showing it to the customer, but will not be responsible for spelling or grammatical errors after receiving approval from the customer.
    • The approval is final and definitive, and the customer cannot request additional changes to the design after conveying their approval.
    • Changes and revisions requested after design approval will be subject to additional charges, and the amount will vary depending on the case.

In the event that the printing or production of the designs is not contracted, the company will provide the customer with digital files of sufficient quality for printing. The company will not provide the customer with editable files; however, the customer can acquire them for an additional cost, the amount of which will be determined by the company and will vary depending on the case.

Production process

The company offers the possibility of printing/producing digital files on physical media, including but not limited to: paper, cardstock, self-adhesive vinyl, canvas, acrylic, polycarbonate, foam PVC, aluminum composite, foam board, PET, MDF, wood, among others. The production process will begin only when the following conditions are met:

  1. Files Provided by the Customer. The files must have sufficient resolution, size, and proportions to be reproduced on the media requested by the customer. If these conditions are not met, the company will offer the customer the possibility to adapt them; if this is not possible, the files will be rejected and returned. The customer assumes direct responsibility and exempts the company from claims regarding:
    • Spelling/grammatical errors
    • Quality/definition of photos
    • Design flaws or inconsistencies
  2. Files Prepared by the Company. Files will only go into production after receiving explicit design approval from the customer. The duration of the production process will vary depending on the type of product requested; this information will be provided to the customer as soon as the services are contracted. Once the production process is complete, the company assumes responsibility for the print quality and material quality. Products can be picked up by the customer or installed by the company if required.

Installation process

The company offers the possibility of installing printed/produced media, such as self-adhesive vinyl, banners, posters, and/or dimensional letters. The customer must notify the company from the beginning of the service contract if they wish to add the installation service to their order. Installations are subject to the following conditions:

  • The approximate installation date will be communicated to the customer from the moment of contracting.
  • The final installation date will be communicated to the customer upon the completion of the production process.
  • The installation date may be subject to changes due to exceptional circumstances; any such changes will always be communicated to the customer.
  • The installation service will be charged according to the complexity of the installation to be performed.
  • Installations will be carried out exclusively within the perimeter of Torrevieja, Alicante.
  • In the event that the customer wishes to have the company install the printed/produced media at a location outside of Torrevieja, they will be responsible for the following expenses: transportation, shipping, fuel, and per diem (when applicable).

Prior to the production process, the conditions defined in Articles 5 and 6 will be applied. The customer has the obligation to accurately notify the company of the location and nature of the installation, taking into consideration the physical properties of the various types of materials used for printing/production. Regarding large format printing, the company will offer the customer different options for quality and durability, and the customer will assume the accepted conditions as described below:

  1. Low range. The lowest and most affordable quality level, generally with a short lifespan, and typically using materials and inks with a short duration. Materials printed in this range are subject to a 1-month warranty for outdoor use after installation.
  2. Medium range. The materials in this category have higher quality and are produced using printing technology that allows for use both indoors and outdoors for a longer period. Materials printed in this range are subject to a 1-year warranty for outdoor use after installation.
  3. High range. The highest and highest quality range on the market. To achieve this level of quality, only the highest quality and most durable materials and printing technologies are used. Materials printed in this range are subject to a 2-year warranty after installation, and a minimum durability of 4 years under direct exposure to sunlight.

The warranties and durations described in the previous sections will be void in the event of vandalism or disaster. No work will be repeated or reinstalled under the premise of future payment by any insurance entity; payment for repeats/reprints must be paid in advance, in full, by the customer.

Online sales service

The conditions described in this article apply exclusively to items in the customization category, namely: keychains, earrings, postcards, stickers, small-format decorations, and others. The customer may request the company to sell their customization products through the website https://shop.moshiedraws.com/. Once their request is approved, the products to be sold are subject to various conditions, depending on the case:

  1. Material produced by Moshie Print. In this case, the sale will only proceed after the production process has elapsed and payment for the order is completed. The company will offer the customer the option to have one or more photo sessions for the products to make them more appealing to potential buyers. These photo sessions will be quoted and paid for to confirm their execution. The products for sale will be listed on the aforementioned website, and the amount paid by the buyer will be divided as follows:

  2. Material NOT produced by Moshie Print. The customer can use the company as a sales channel, provided that they send their stock of materials to be sold by postal mail. Additionally, the customer will be responsible for the print quality of their products, as well as the quality of the materials, and they exempt the company from any liability related to their deficiency, as required or claimed by the buyer. In case the customer does not have official photographs, the company will offer the customer the possibility of conducting one or more photo sessions for the products to make them more appealing to potential buyers. These photo sessions will be quoted and paid for to confirm their execution. The products to be sold will be listed on the aforementioned website, and the amount paid by the buyer will be divided as follows:

In both cases, the company will be responsible for shipping the product(s) to the buyer and declaring any taxes paid by the buyer if they reside within the European Union. The products shipped to the buyer will be subject to the warranty conditions described in Article 7, Section 7.2 (Medium range), and the refund conditions described in Article 4, Section 4.2.1 (Small format).

Licenses and intellectual property

The company operates in the field of visual and graphic arts. Therefore, we work with a wide variety of files that can be provided by the customer or authored by the company. The rights to the files and printed goods processed by Moshie Print fall into the following categories:

  • Distribution right: allows the holder to distribute files or printed goods for advertising purposes.
  • Modification right: allows the holder to modify the appearance, presentation, and content of the work, requiring the possession of editable files.
  • Printing right: allows the holder to print and reproduce digital files on printed media for their intended purposes.
  • Commercial right: allows the holder to economically exploit files or printed goods, with the distribution right being essential.
  • Full right: allows the holder to exercise all of the aforementioned rights.

Considering the rights mentioned above, the relevant rules will be applied based on their authorship:

  1. Own designs. Own designs refer to any file, visual concept, branding, layout, or redesign entirely created by the company. Since the creative effort and work are the authorship of the company, it retains full rights over the works. The company reserves the right to use any file over which it has full rights for advertising and digital marketing purposes, without requiring the client's authorization for this purpose.
  2. Mixed designs. Mixed designs encompass files resulting from a creative process in which the client has played an essential role by providing the main visual resources highlighted in the digital or printed files. These elements may include logos, corporate colors, licensed official photographs, among others. The client will not lose any pre-existing rights over the files they have provided, and the company will retain distribution and printing rights.
  3. External designs. This category encompasses all files provided by the client that are already finalized and meet the necessary requirements for printing or production, with minimal or no intervention required from the company. These requirements include:
    • Resolution: Files should have a resolution of at least 300 dots per inch (DPI) if provided in a bitmap format. This requirement does not apply to vector files.
    • Dimensions: Files should have dimensions corresponding to the size at which they are to be produced. It is possible to provide files at scale or in vector format for large-format production.
    • Format: Files should be provided in any of the following print-ready formats: JPG, TIFF, PSD, PDF, AI, EPS, CDR, SVG.

The company will not be responsible for copyright infringements in the case of mixed or external designs, with full responsibility for such infringements resting on the client.

Term and Applicability

Moshie Print reserves the right to modify or update these terms and conditions at any time without prior notice. These modifications will take effect immediately upon their publication at the following address: https://moshieprint.com/terms.

The terms and conditions described in this document will be used as legal defense in the event of any dispute or conflict that may arise in relation to the contracted services. These terms and conditions represent a binding agreement between the customer and the company.
